Job Description

Responsible for ensuring quality and cost-effective Litigation Management. Litigation Management supports claims examiners and claim leadership and works with external defense and coverage counsel.  This position entails selection, appointment, evaluation, and oversight of our panel of competent counsel/firms for all jurisdictions.  The Litigation Management Team coordinates feedback from claims examiners and claims leadership and helps to develop, monitor and train relative to internal process, initiatives and procedures to ensure that examiners and counsel jointly strategize to effect sound claim resolutions.

Essential Functions:

  • Internal Oversight:  Reviews and audits examiner compliance with established litigation management protocols and procedures. Provides direction and feedback to examiners and leadership.
  • Screen and Appoint New Defense Counsel: Consult with various resources to locate potential counsel for approved list.  Screen potential counsel via in-person visits and research the firm expertise to determine if they are a suitable business partner. 
  • Evaluate Defense Firms: Evaluate current firms through firm visits, mediation/trial attendance, file audits, bill audits, soliciting feedback from examiners and leaders.   Focus on quality, cost effectiveness, and goal-oriented strategy communication.  
  • Communication with Defense Firms: Maintain open lines of communication with defense firms and provide feedback on their performance.  Conduct in- person visits at defense firm offices across the country and Canada.  Negotiate billing rates and approach firms for billing issues as appropriate.   Continually campaign our Claim Department Story.
  • Address Issues With Billing: Conduct review of legal bills to ensure compliance with Retainer agreement to ensure that expense authority and next steps are in place.  Any billing concerns are discussed directly with counsel. 
  • Internal Communication with Claims Leadership: Identify and address areas for individual coaching or global training needs within claims with focus on sound litigation management and attorney direction.  Recommend process/procedures to support sound litigation management and examiner/counsel partnership.
  • Continuing Education and Legal Training Coordinator: Coordinate and organize 12+ hours of adjuster continuing education per year which is approved by Florida Insurance Department.  Coordinate other relevant legal training seminars for claims, underwriting, and customer attendance. 
  • Attend Mediations and Trials: Observe and assess defense counsel at mediations, oral arguments and trials across the country.  Provide feedback and coaching.  Ensure stellar results are achieved.
  • Trial Preparation: Provide help and resources to claims examiners and defense counsel on files going to trial.  Review deposition transcripts, pleadings, motions, case law, experts, etc. in preparation for trial.

Other Duties and Responsibilities:

  • Resource: Assists underwriting and claims in researching jurisdictional and legal trends via communication with counsel. 
  • Special ProjectsComplete special projects assigned by Senior Vice President, Chief Claims Officer and/or Litigation Manager.
  • Continuing Education: Enroll and complete continuing education programs for both professional and personal development as outlined in annual Training and Development Plan.
  • Working Conditions:  Travel as needed including mediations, oral arguments, trials, office visits, and conferences including overnight stays.
  • Specific Skills: Strong oral and written communication skills, strong leadership and interpersonal skills,conflict management skills, strong analytical skills, strong organizational and time management skills, ability to work independently in a fast-paced environment.

Requisite Knowledge, Skills and Experience

  • Education: JD required.
  • Experience: 3-5 years of: litigation experience as a practicing attorney, litigation management experience within an insurance company and/or claims handling experience.
